Estate Administration

The administration of an estate can be very stressful, due to the emotions associated with death and the degree of attention that is required to put a deceased’s affairs in order. We can help with those roles that specifically require a lawyer’s involvement and with respect to providing administrative support as requested.

Did you know that it is a common misconception that the lawyer who prepared the will must also be the lawyer who advises the estate trustee (formerly known as “the executor”)? In fact, the lawyer who advises the estate trustee is as chosen by the estate trustee, unless there is a provision of the will by which a particular lawyer is appointed.

The Role of the Lawyer is to provide general advice to an estate trustee with respect to estate administration. The lawyer will also prepare the application to the court to obtain the Certificate of Appointment, as well as any documents necessary to transfer assets and settle the estate with the beneficiaries.
